Every child is entitled to a legal connection to their fathers. Establishing paternity entitles children to benefits such as Social Security benefits, Veteran benefits, inheritance rights, and access to their cultural and medical history. TCSS will work with both parents to establish paternity. Paternity must be
established before a court can order child support.
TCSS has been trained to properly collect DNA samples. TCSS utilizes certified labs to test the collected DNA in order to establish paternity. DNA testing is available at a reasonable cost to parties or, in some cases, may be available free of charge.
By working with Tribal and/or State courts, TCSS will utilize child support guidelines that will establish a monthly payment amount and a child support order aimed at meeting the needs of your children.
If you have a child support order & the noncustodial parent has not paid, TCSS will work with you to enforce the order. TCSS can request an income assignment that will have your child support withheld directly from the non-custodial parent's salary, unemployment, per capita, or other income. In addition, TCSS can place a levy on bank accounts, intercept Federal and State tax refunds, and place liens on worker's compensation and other awards.
To ensure that monthly child support payments are in compliance with current child support guidelines, TCSS will review child support
orders for modification, upon request.
TCSS uses all the latest locate tools to assist in locating the absent parent. These tools include Local, State, Federal, and internet information. However, the best tool for location is the
custodial parent.
TCSS is committed to ensure that all funds received are directly disbursed to the custodial parent in a timely manner. Families may
request their child support payment to be deposited directly into their bank account, or placed onto a debit card. Funds will be
disbursed in accordance with Federal guidelines, recognizing family first.
TCSS has a Supervised Tribal Enforcement Payment Program ("STEPP"). This program works with the non-custodial parent to ensure that they find employment and remain current on their monthly child support payments.
